www.wefund.co.uk and www.wefund.com (We Fund Limited) (“Wefund”) is an online fund raising platform. Wefund connects project creators (“Creators”) with potential financial backers (“Backers”) in the form of online pledges allowing Creators to raise money for these projects from fans, friends and family.   Creators set the amount they need to raise (the “Campaign Target”) in order to complete the project (“Campaign”) in return for a series of perks (the “Perks”) they design.  These Perks are meant to incentivise the Backers in to contributing funds towards reaching the Target in the time specified by the Creator (the “Timeframe”).  If the Campaign Target has been reached (or exceeded) within the Timeframe then each of the Backers’ credit/debit cards are charged with the amount they have pledged and the funds are collected by Wefund and then sent to the Creator’s account (the “Service”).

Once the Creator has received monies from its Backers it must complete the project and deliver the Perks to the Backers as promised.  

IN ORDER TO FACILITATE THIS WE REQUIRE THAT ALL USERS OF THE SERVICE ABIDE BY THIS CODE OF CONDUCT. WEFUND MAY MODIFY THE TERMS OF THIS CODE OF CONDUCT, IN OUR SOLE DISCRETION, BY POSTING AMENDED TERMS TO THE WEFUND.CO.UK WEBSITE. YOUR CONTINUED USE OF THE SERVICE INDICATES YOUR ACCEPTANCE OF THE AMENDMENTS.

1.       Wefund hereby grants you permission to access and use the Service, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:

          (i)   you agree not to access Content through any technology or means other than the video playback pages of the Site itself, or such other means as Wefund may explicitly designate for this purpose;

          (ii)   you agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Service or features that (i) prevent or restrict use or copying of Content or (ii) enforce limitations on use of the Service or the content accessible via the Service;

          (iii)   you agree not to use the Service for any of the following commercial uses unless you obtain Wefund's prior written approval:

          (iv)   you agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Service in a manner that sends more request messages to the Wefund servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;

          (v)   you agree not to collect or harvest any personal data of any user of the Site or any Service (and agree that this shall be deemed to include Wefund account names);

          (vi)   You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Wefund or the respective licensors of the Content.

Wefund is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Service which Wefund provides may change from time to time without prior notice to you.

2.       When using the Service activities that are not permitted include, but are in no way limited to, the following:

          (i)   to act in an abusing or threatening way;

          (ii)   to intimidate or impersonate anyone;

          (iii)  any illegal acts;

          (iv)  any infringement of intellectual property rights;

          (v)  any commercial activities not approved in writing by Wefund

3.       You will not to post, email, or otherwise make available Content:

          (i)  that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another’s privacy, or is harmful to minors in any way;

          (ii)  that is pornographic;

          (iii)  that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

          (iv)  that impersonates any person or entity, including, but not limited to, a Wefund employee, or falsely states or otherwise misrepresents your affiliation with a person or entity;

          (v)  that includes personal or identifying information about another person without that person’s explicit consent;

          (vi)  that is false, deceptive, misleading, or deceitful;

          (vii)  that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;

          (viii)   that constitutes or contains “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or unsolicited commercial advertisement;

          (ix)  that constitutes or contains any form of advertising or solicitation;

          (x)  that includes links to commercial services or web sites;

          (xi)  that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law;

          (xii)  that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

          (xiii)   that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users’ ability to use the Service; or

          (xiv)   that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.

4.       You agree not to:

          (i)   contact anyone who has asked not to be contacted;

          (ii)  “stalk” or otherwise harass anyone;

          (iii)  collect personal data about other users for commercial or unlawful purposes;

          (iv)  use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service – unless expressly permitted by Wefund;

          (v)   post irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure; or

          (vi)   attempt to gain unauthorised access to Wefund’s computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or Wefund website.
